New Form I-9 Effective 4/3/09


As before, employers are also required, within three days of hiring a new employee, to examine original documents presented by the employee (such as a U.S. passport, or a driver's license and social security card), and ensure that those documents confirm the employee's identity and employment authorization.

 

The new version of the form contains only a few modifications to the current version of the form. 
 
        •The form now provides separate boxes for the employee to claim status as either a "citizen" or a "national" rather than one box to claim status as a "citizen or national" on the current form. 
 
        •The “List of Acceptable Documents,” found on the reverse of the form, which was last changed in 2007 to make the form’s instructions match the regulations promulgated in 1997, has been amended again to eliminate references to certain documents no longer issued by USCIS and to update references to certain other documents.
 
        • The most important change is that the new regulations and I-9 form now require that any document presented for I-9 purposes be unexpired (except documents such as Social Security Cards or birth certificates that have no expiration date).   
 
        • Makes clear that a Social Security Card cannot be accepted if it specifies on the face that the issuance of the card does not authorize employment in the United States.


USCIS will require sole use of the new I-9 form immediately.  A copy of the new I-9 form is attached and you should begin using it now.  You can also download the new I-9 form from the USCIS web site at http://www.uscis.gov/files/form/I-9_IFR_02-02-09.pdf or download the form from the Human Resource Services website under Employment Information.

 

When completing I-9’s please remember to include all four of the sheets (Instructions sheets and List of Acceptable Documents) with the I-9 form. 

Beginning immediately, our office will return any I-9’s that were prepared using the outdated version.
